Il rapporto tra AOI e NASpI è oggi governato da un’incompatibilità legislativa con diritto di opzione; tutta-via, tale modello risulta sempre meno coerente con la diversa funzione delle due prestazioni e con i prin-cipi costituzionali di eguaglianza e adeguatezza. La soluzione legislativa appare coerente con l’impostazione della Corte costituzionale (sent. n. 234/2011), ma la recente giurisprudenza di legittimità ne ha attenuato la rigidità, escludendo decadenze non previste dalla legge e negando la riconducibilità allo schema delle obbligazioni alternative. Ne emerge un sistema in tensione, nel quale l’incompatibilità, pur formalmente vigente, appare sempre meno giustificata sul piano funzionale, aprendo il problema del-la sua tenuta alla luce degli artt. 3 e 38 Cost.
The relationship between invalidity allowance (AOI) and unemployment benefits (NASpl) is currently governed by a statutory rule of incompatibility combined with a right of choice. However, this model appears increasingly inconsistent with the different functions of the two benefits and with the constitutional principles of equality and adequacy. While the legislative solution is consistent with the approach adopted by the Constitutional Court (judgment no. 234/2011), recent case law of the Court of Cassation has mitigated its rigidity, excluding non-statutory limitation periods and rejecting its classification within the framework of alternative obligations. The result is a system under tension, in which incompatibility, although stillformally in force, appears increasingly unjustified from a functional perspective, raising questions as to its constitutional sustainability in light of Articles 3 and 38 of the Constitution.
