In defining compensation for traumatic knee pathology, a correct medico-legal evaluation judgment must consider a complete anamnestic reconstruction not separated from the biomechanical context of the accident dynamics and of the harmful efficacy, a deep knowledge of the relationship of the legal contract, objective semiotic investigations and a careful interpretation of the instrumental investigations carried out by the insured. Alongside the borderline cases, in which diagnostic imaging may be sufficient to demonstrate the pre-existence of the lesion, there are numerous situations in which the iconographic data may be misleading if not subjected to accurate medico-legal analysis. The authors note that the definition of risk must include the deterioration of natural and non-pathological organ-tissue structures, and the physical conditions relating to the physiological or paraphysiological sphere which may have had a merely potential role in contributing to the lesion do not preclude compensation.
