La responsabilità solidale tra litisconsorzio necessario e bilancio di liquidazione negativo dell’appaltatrice

This contribution, starting from the decision of the Court of Appeal of Bologna, examines joint and several liability in the contracts referred to in art. 29 Legislative Decree n. 276/2003 (as resulting from the introduction of the, now repealed, procedural rule of the necessary joinder) as well as the complex discipline referred to in art. 2495, paragraph 3 of the Italian Civil Code, with the aim of verifying the conformity of the ruling cited with the jurisprudence of legitimacy.

L’estinzione della società appaltatrice-datore di lavoro con chiusura del bilancio di liquidazione in negativo esonera il lavoratore dal chiamare in causa con il committente gli ex soci della stessa, sebbene il credito sia sorto anteriormente alla modifica dell’art. 29, comma 2, D.Lgs. n. 276/2003 che ha eliminato la regola processuale del litisconsorzio necessario negli appalti.
