The essay moves from awareness that the qualification of waste as a “Legal asset” is necessary in order to achieve a European market model based on the “Circular economy” and sustainable development. In a systematic and axiological perspective, the idea of “waste” as an object of a property right makes it possible to apply the principles and rules of property, as well as their limitations, allowing waste goods to conform to the pursuit of a social utility.
